Any tenancy agreement can be in writing or made verbally and is the contract between a tenant and their landlord. This tenancy agreement provides specific rights to tenants and landlords alike, for instance, the right to reside in the property and a landlord’s entitlement to receive rent as compensation for letting out their property. A tenant and the landlord may agree certain aspects of the tenancy with these points being included in a tenancy agreement; providing that they do not go against the law. Both tenants and landlords have certain responsibilities and rights as specified by the Housing Act; a tenancy agreement may offer both parties additional rights over and above any legal rights, but the agreement may not give a tenant less than their legal privileges. Should any term in a tenancy agreement provide either party with less than their statutory rights, then that term will not be enforceable.

If a tenant does have an agreement in writing then this must state the tenancy type and every tenant, in the case of joint tenants, must be given a copy of the agreement. - The date the tenancy started.
- The landlord’s name and the address.
- The address of the property being rented out.
- What services the landlord is providing.
- Details of any other individuals who are permitted to live in the property.
- The length of the tenancy and the date that it will run out on.
- The amount of rent that is to be paid, frequency and the date it should be paid on.
- Details of when the rent can be reviewed.
- What else the rental payment incorporates, for example, water rates or council tax.
- The period of notice required from either side if they wish the tenancy to terminate.

There are legislative rules about the amount of notice that must be provided and these rules are governed by the type of tenancy and the reasons for termination.
